Consumer Protection Bill was introduced in Lok Sabha in 2019 replacing the Consumer Protection Act, 1986. The bill has defined customer rights including the following: 

  • Protection against marketing goods and products which are harmful to life.
  • Information regarding quality, quantity, purity, standard and price of goods and services.
  • Access to different products and services at competitive costs.
  • Reimbursement against unfair and fraudulent trade practices.
  1. Penalties for misleading advertisement. – The CCPA can impose a penalty of up to Rs 10 lakhs and two year imprisonment for misleading or false advertisement. The fine may be extended to Rs 50 lakhs and the imprisonment may extend to five years.
  2. Right to complaint anywhere. – As per this new rule, consumers are allowed to file a complaint from anywhere be it home, office or anywhere else.
  3. Right to Seek compensation under product liability – In case any loss is caused to a consumer due to a defective product, the consumer can file the complaint against the manufacturer or the service provider and ask for compensation. The manufacturer or seller would be held liable if the product does not confirm to express the warranty.

As per Consumer Protection Act 2019 – “consumer” means any person who—

  1. buys any goods for a consideration which has been paid or promised or partly paid and partly promised, or under any system of deferred payment and includes any user of such goods other than the person who buys such goods for consideration paid or promised or partly paid or partly promised, or under any system of deferred payment, when such use is made with the approval of such person, but does not include a person who obtains such goods for resale or for any commercial purpose; or 
  2. hires or avails of any service for a consideration which has been paid or promised or partly paid and partly promised, or under any system of deferred payment and includes any beneficiary of such service other than the person who hires or avails of the services for consideration paid or promised, or partly paid and partly promised, or under any system of deferred payment, when such services are availed of with the approval of the first mentioned person, but does not include a person who avails of such service for any commercial purpose.
  • You should have purchased the products on your name
  • The case should fall under the definition of Consumer Dispute
  • The case should be filed within 2 years of cause of action

As per the revised pecuniary jurisdiction for entertaining consumer complaints shall be upto –

  1. 50 lakh for District Commissions,
  2. More than ₹50 lakh to ₹2 Crore for State Commissions and
  3. More than ₹2 Crore for National Commission
